Your Right to Sue the At Fault Driver Directly.

Because motorcyclists are not covered by mandatory PIP insurance under KRS 304.39-040(4), you are not subject to the no fault threshold that limits car accident claimants. You can pursue the at fault driver’s liability insurance for the full value of your claim from the first dollar, including medical expenses, lost wages, pain and suffering, and all other damages, without needing to clear a medical expense threshold.

Motorcycle Accident Claims Questions

  • In a standard car accident, your own PIP insurance covers your first $10,000 in medical expenses and lost wages regardless of fault. Motorcycle operators do not have this protection unless they specifically purchased optional PIP for the motorcycle. This means you have no immediate insurance cushion and must pursue recovery directly from the at-fault driver’s liability coverage from the beginning.

  • A driver’s failure to see a motorcyclist does not reduce their liability. Drivers have an affirmative duty to observe all lawful users of the road, including motorcyclists. Failure to look before changing lanes, turning, or entering an intersection is negligence regardless of whether they claim the motorcyclist was not visible.

  • Kentucky does not have a universal helmet law for all adult riders. Whether you were wearing a helmet may be raised by the defense as a comparative fault argument if your injuries are head-related, but it does not bar your claim. Kentucky’s pure comparative fault system means your damages are reduced by your percentage of fault, not eliminated.

  • Permanent injuries, including spinal cord damage, traumatic brain injury, limb loss, or permanent disfigurement, significantly increase the value of a claim. Future medical expenses, reduced earning capacity, and long term pain and suffering are all recoverable. 

  • You may recover all medical expenses past and future, lost wages, reduced future earning capacity, pain and suffering, emotional distress, property damage including the motorcycle, and in cases of egregious conduct, punitive damages under Kentucky law.

  • Seek medical attention before anything else. Do not give any statement to the other driver’s insurer. Document the scene with photos of all vehicles, road conditions, and your injuries if possible. Get witness names and contact information. Report the accident to law enforcement. Then contact an attorney as soon as possible because the one year deadline applies from the date of the accident.
