Under KRS 235.300, a boat owner is liable for injuries and property damage caused by the operation of their vessel. This means that even if the owner was not driving, they may still face liability if the operator was using the boat with their permission. Owners have a duty to ensure their vessel is operated safely and by qualified individuals.

Your Right to Hold Intoxicated Operators Accountable. Under KRS 235.240, operating a motorboat with a blood alcohol concentration of 0.08% or higher is unlawful in Kentucky. Evidence of intoxication at the time of the accident supports a negligence claim and may support a claim for punitive damages where the conduct was particularly reckless. A prior BUI conviction is relevant evidence in a civil case.

However, some accidents on navigable waterways may also implicate federal maritime or admiralty law, which can affect the legal framework and the forum where a claim is pursued. In a civil case, the standard of proof is preponderance of the evidence, which is a lower threshold than the beyond a reasonable doubt standard in criminal proceedings. Seek medical attention first. Report the accident to the Kentucky Department of Fish and Wildlife Resources as required by KRS 235.250 if injuries or significant property damage occurred.
